April 20, 2007 - Andy Cziotka joins Draves Law Firm

The Draves Law Firm, P.A. has been honored to have Andy Cziotka working with us these past two months. Andy is a third year law student at Barry University of Law and will be graduating in May. He intends to take the Bar exam in July. It has been a pleasure working with him.

In other news, Donna L. Draves and Lori Caldwell-Carr attended the Family Law Conference at the Grand Floridian Resort and Spa at the Walt Disney World Resort in January. One substantial change that was discussed was the termination of Permanent Periodic Alimony based upon a supportive relationship.

Florida Statute 61.14(b)1. states:

The court may reduce or terminate an award of alimony upon specific written findings by the court that since the granting of a divorce and the award of alimony a supportive relationship has existed between the obligee and a person with whom the obligee resides. On the issue of whether alimony should be reduced or terminated under this paragraph, the burden is on the obligor to prove by a preponderance of the evidence that a supportive relationship exists.

Also discussed was the new statute concerning relocation, Florida Statute 61.13001. The statute, which entered into effect on October 1, 2006, permits a party in a dissolution of marriage action a means through which to seek to relocate with minor children prior to a Final Judgment being entered.
